DCF Intervention

When reunification with biological parents is not possible, a biological parent can opt to place his or her child for adoption with a family of their choice through an intervention adoption facilitated by an adoption attorney. This process allows the child to be adopted by a relative or another suitable family, provided the biological parents’ rights have not been terminated. Florida Statutes, Section 63.082(6)(a), permits parents to consent to their child’s adoption by a chosen family, even while under DCF supervision, under specific legal circumstances before parental rights are terminated.

This intervention can accelerate permanency for the child and give the birth parent control over their child’s future, including selecting the adoptive family. However, during the hearing, the judge will ultimately determine the best placement for the child, taking the biological parent’s wishes into account.

We walk you through the process.

DCF Intervention:
You’ve got questions. We’ve got answers.

What is intervention adoption and when is it used?

Intervention adoption is a process where a biological parent places their child for adoption with a family of their choice, facilitated by an adoption attorney. This option is typically used when reunification with biological parents isn’t possible and allows the child to be adopted by a relative or another suitable family while ensuring the biological parents’ rights have not yet been terminated.

What legal provisions exist for intervention adoption in Florida?

Under Florida Statutes, Section 63.082(6)(a), biological parents are allowed to consent to their child’s adoption by a preferred family, even while under the supervision of the Department of Children and Families (DCF). This can occur under specific legal circumstances before their parental rights are terminated, providing parents control over their child’s future and the opportunity to select the adoptive family.

How does the legal process work during an intervention adoption?

During the hearing for an intervention adoption, a judge will ultimately determine the best placement for the child by taking into account the biological parent’s wishes. While the parent’s preferences are considered, the judge’s decision focuses on what is in the best interest of the child, aiming to accelerate permanency in their living situation.
